Terms of service

1. Application of These Terms

These terms describe the conditions on which we offer our website and products.

Before completing a purchase, you must have a reasonable opportunity to review the applicable terms and order details. Agreement will be obtained through the ordering process where required.

Nothing in these terms excludes mandatory consumer rights. Where a provision conflicts with applicable law, that law prevails.

2. Eligibility and Information Accuracy

You must have legal capacity to enter the transaction or act with legally sufficient authorisation.

You agree to provide accurate billing, delivery, and contact information and to use a payment method you are authorised to use.

If an account feature is available, you are responsible for taking reasonable steps to protect your credentials and notifying us of suspected unauthorised access. This does not make you automatically liable for every action performed through a compromised account.

3. Permitted Website Use

You may browse the store and use its functions for lawful shopping and related purposes.

You must not knowingly:

  • Submit fraudulent orders or false payment information.
  • Interfere with checkout, security, or website operation.
  • Introduce malicious code.
  • Attempt unauthorised access to systems or another person’s information.
  • Use store content in a way that infringes another person’s rights.
  • Send unlawful, threatening, or abusive material through our support channels.

Any restriction we impose in response will be proportionate and will not remove obligations owed to you for an existing purchase.

4. Product Information

We aim to describe products accurately. Before purchasing, review the item’s stated characteristics, dimensions, materials, and other relevant information.

Images are intended to assist selection. Screen settings may affect colour appearance, but this does not excuse supplying an item that materially differs from its description.

Availability can change. If an ordered item becomes unavailable, we will contact you and offer an appropriate resolution. We will not substitute a materially different item without your agreement.

5. Prices and Charges

The currency applicable to your transaction will be identified during shopping or checkout. Review the final currency and total before submitting your order.

Applicable taxes and any permitted additional charges will be disclosed before you commit to the purchase.

Standard shipping is free on all orders accepted through the store. We do not impose a minimum order value for that service.

Price changes apply to future purchases and do not retrospectively increase the price of an accepted order.

6. Order Formation

Submitting an order is a request to purchase the selected items on the terms presented at checkout.

An automated receipt acknowledges that we received the order. Unless an earlier communication expressly accepts it or applicable law provides otherwise, acceptance occurs when we send confirmation that the order has been dispatched.

If we cannot accept an order, we will notify you and promptly refund any amount collected for it. We will not leave a paid order unresolved while reserving an unlimited right to decide whether to accept it.

The order-formation process does not postpone any obligation that applicable law attaches to taking payment or concluding an online transaction.

7. Payment

Payment must be authorised through a method offered at checkout.

A payment provider may decline or require verification of a transaction. If a problem prevents fulfilment, we may request a different authorised payment method or cancel the order and refund collected funds as appropriate.

We do not request payment passwords or card security codes by email.

Charges imposed independently by your bank, such as currency-conversion fees, are governed by your agreement with that provider.

8. Errors and Order Changes

If a material pricing, description, or availability error affects your order, we will contact you with the relevant information.

We will not automatically charge an increased amount or send a materially changed item. Where a correction requires your agreement, you may accept it or receive a refund for the affected purchase, subject to applicable law.

If you need to change or cancel an order, contact us promptly. Dispatch may prevent an operational change, but your return rights and statutory cancellation rights remain available.

9. Shipping and Delivery

Our estimated delivery period is 15–20 calendar days from order confirmation, including processing.

The Shipping Policy explains tracking, delivery issues, and address requirements. Delivery estimates do not excuse an indefinite failure to fulfil an order.

If we cannot deliver as agreed, we will communicate with you and provide the remedies available under our policies and applicable law.

We do not treat handover to a carrier as automatically ending our responsibility to you.

10. Returns and Refunds

Eligible change-of-mind returns may be requested within 30 calendar days after delivery, subject to the Return and Refund Policy.

Different conditions apply to defective, damaged, incorrect, or legally non-conforming products.

Refunds owed under mandatory law will be handled within the required period, even if that differs from the routine processing estimates in our policies.

11. Product Use and Legal Warranties

Use products according to their stated purpose and any supplied care or safety instructions.

Damage caused by misuse, unauthorised alteration, or normal wear does not automatically establish a product defect. Each issue will be assessed on its circumstances.

Nothing in these terms excludes a legal warranty, required standard of quality, or remedy that cannot lawfully be excluded. A manufacturer’s warranty, if provided, is additional to applicable rights against us.

12. Website Availability

The website may occasionally be unavailable because of maintenance, technical faults, or events outside our reasonable control.

We do not guarantee uninterrupted access to browsing functions. However, an outage does not remove your rights in relation to an existing order or justify withholding a refund owed to you.

If the store is unavailable, you may contact info@spraygroundh.shop.

13. Intellectual Property

Website text, graphics, photographs, designs, and other protected materials belong to their respective rights holders.

You may view and use store information for personal shopping purposes. Additional reproduction, distribution, or commercial use requires permission where the law requires it.

Third-party names and marks remain the property of their owners. Their appearance does not, by itself, establish an endorsement or affiliation.

14. Customer Submissions

If you voluntarily submit a review or other material for publication, you must have the right to share it.

You retain ownership of your submission. You grant us a non-exclusive permission to display and format it for the purpose for which you submitted it, subject to applicable privacy and consumer law.

We will not use a private support message as a public testimonial without your permission.

We may remove unlawful, abusive, fraudulent, or irrelevant submissions. We will not edit a review in a way that materially misrepresents its meaning.

15. Third-Party Services

External links or optional third-party services may be governed by their providers’ terms.

Review those terms before using the service. We remain responsible for our own representations and obligations and do not use third-party involvement to avoid responsibility that the law places on us.

16. Responsibility and Remedies

Responsibility for loss will be determined under applicable law and the circumstances.

We do not exclude liability for fraud, wilful misconduct, gross fault where applicable, injury for which liability cannot be excluded, or breach of mandatory consumer obligations.

These terms do not impose a blanket purchase-price cap on your remedies.

You should take reasonable steps to avoid preventable loss, but doing so is not a condition that removes a remedy otherwise available by law.

17. Events Outside Reasonable Control

Severe weather, transportation interruptions, public emergencies, and similar events may affect performance.

If such an event affects your order, we will take reasonable steps to communicate the problem and identify a resolution. These events do not authorise us to retain payment indefinitely or suspend mandatory cancellation and refund rights.

18. Disputes and Applicable Law

Please contact info@spraygroundh.shop if a concern arises.

Nothing requires you to complete our internal complaint process before exercising a legal right, contacting a regulator, or pursuing an available payment dispute.

These terms are subject to the applicable laws of Canada and the province or territory whose laws govern the transaction. Consumers retain mandatory protections and access to competent courts provided by applicable law.

These terms do not require compulsory arbitration or waive any legally protected right to participate in collective proceedings.

19. Changes and Severability

The terms presented when you place an order govern that order, unless a later change is legally required or you agree to it.

We may revise these terms for future transactions. Material changes will be notified where required.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not automatically waive it for every future situation.
